Tourist rental as a source to supplement your income - advantages and disadvantages and what the regulations say.

Since 2020, Catalonia has a new regulation for housing for tourist use. As of this date, shared accommodation for tourist purposes, such as Bed & Breakfast, is also regulated.

Decree 75/2020, of August 4, 2020, on tourism in Catalonia, repeals, among other regulations, Decree 159/2012, of 2012 , tourist accommodation establishments and housing for tourist use.

It is important to distinguish between housing for tourist use and a shared home.

What is there to know about housing for tourist use?

- The dwellings cannot be occupied with more places than those indicated in the certificate of occupancy.
-Likewise, the maximum capacity cannot exceed 15 places in order to reconcile the activity of tourist accommodation with neighborhood coexistence, the right to rest and the provision of a quality service.
- Any occupation of the dwelling for a continuous period of time equal to or less than 31 days is considered a seasonal stay.
- Homes for tourist use are ceded in their entirety, cession by stays is not allowed.

And what about shared home?

- It is the main home residence of the holder and that is shared as an accommodation service with third parties in exchange for financial consideration and for a seasonal stay.
- The decree does not expressly regulate the tourist rental by rooms.
- Instead, it includes a new type of tourist accommodation: shared home.
- Homes that are not duly registered as a shared home cannot be transferred.
- The owner must reside in the home for the duration of the stay.
- The maximum capacity of seats for tourist users is 4 in total.

In addition, Law 5/2020, of April 29 2020, on fiscal, financial, administrative and public sector and creation of the tax on facilities that affect the environment, must be taken into account.You also have to check with the town hall of your municipality what to do to obtain a tourist rental license.
